I am sure that lawsuits would be made but other countries in Europe have this concept of "it is illegal to be uninsured" for ages so I'm sure there's lots of litigious material the decision is based on.

As someone who used to be a claims assessor in a former life, I would say precedents in Scottish Law are irrelevent when it comes to English Law.
